Injured 'Mermaid' actor sues Disney

Adrian Bailey, an actor working in "The Little Mermaid" who was severely injured when he fell more than 30 feet to the stage before a May 10 performance at Broadway's Lunt-Fontanne Theatre, is suing Disney, the show's primary producer.

The show's prop and set manufacturers also are named in the suit, filed Thursday in Manhattan Supreme Court.

The suit, which seeks unspecified monetary damages, alleges that Bailey's injuries "were caused by the carelessness, negligence and recklessness of the defendants." Bailey, who has been hospitalized since the accident, alleges that there were insufficient "warnings and/or safety devices" that could have prevented the accident.

A Disney spokesman said the company would have no comment.

Bailey also is suing George Tsypin Design and Showman Fabricators, two companies based in Queens that design, manufacture and assemble sets, and Niscon, a Canadian company that specializes in motion control systems for the entertainment industry.
